Message: Hi,I am working with a private limited company since February 2006. Due toreasons alien to me the company has not deducted income tax from my salaryso far. Through a chartered accountant i paid advance tax in the month ofDecember after calculating the tax based on my salary income andinvestments. The logic behind the payment of advance tax was to avoid anyinterest accrued for the accumulated tax and to avoid heavy tax cut duringJan-Mar. But to my surprise and dismay, the company refuses to accept theadvance tax citing that they cant accept tax paid outside of TDS.In this context,1) Is the company within their rights in not accepting my advance tax paidreceipts?2) Does a citizen need to pay advance tax (in accordance with thedeadlines issued by the IT dept) in case of salary issuing company notdeducting the tax at source?3) Are there any specific guidelines for TDS by which the heavy tax cutduring the last 2-3 months by the company is prevented?4) Does a salaried person need to pay interest for tax not paid (by theemployer) within the stipulated deadlines for paying the advance taxinstalments? Please give some advise. Regards,Ganesh

Message: Dear Sir, Following are my queries requested under "Expert Advice" feature of your web site. First to briefly introduce myself and my case to you; I am a seaman by profession working with foreign companies on foreign flag ships. My knowledge of taxation is very limited, in fact all i understand is that, if a person remains abroad more than 183 days during a financial year and haves earnings from foreign country in foreign currency haves a NRI status and is exempted from income tax. To further clarify my case, my merchant navy job is my only source of income, my annual income is equivalent to approx 7-8 Lakh Indian rupees per annum. I have a NRI account to which my salary is remitted. I usually stay abroad for 8 - 9 months ( ie. more than 180 days) and get paid in US dollars. Kindly reply to following queries regarding taxation and PAN card requirements with reference to my above explained case, as it seems a mandatory requirement for all financial purposes such as loan/ investments etc. 1. Do I need to furnish ITR in my case? (i have never done so in past) 2. Do I need to have a PAN? / Can I have a PAN? ( In my case whereby i stay abroad for more than 183 days and gets paid in foreign currency) 3. Does having a PAN means that , i have to file my ITR every year? Kindly oblige with reply to above queries. Thank you. yours faithfully Anil Kumar.

To get tax benifit, we need to invest 1 lac Rs.every year, does it mean that my back year policies premium can not get inculded in tax exemtion limit of this year. Is it tax rule says that I have to invest every year Rs.1 lac despite of my back year invetment, if yes then why can't it get carrry forward to next year?
