Hi
Kotak Securities used to be my broker. They used to operate my account inthe F&O, using the POA that I signed as part of the manadatory requirementreg account opening. As I am a small retail investor, who had justentered the capital market just 3 years ago, I trusted Kotak. I hadgradually invested approx 4 lakhs in shares, and held them in the demata/c with Kotak. However, in May 2006, they inflicted a huge loss of more than 5 lakhs inmy account, by trading in F&O on their own. Their explanation is theselosses are only "normal" in the F&O. They also sold off my entireequities to adjust this loss.Shocked at their callousness, it was then I realized I am being taken fora ride. My subsequent investigations revealed that they have takenexposure of almost 9 times of the value of my equity holdings, for F&Otrades.I complained to SEBI, pursuant to which, they sent me legal notices, claiming that I did the trades and am now defaulting in paying off thebalance. The matter has now come before NSE for arbitration. While I believe Iwill get justice at NSE, wanted to highlight this to you so that you canwarn other innocent investors and prevent them from being exploited byunscrupulous broking firms. Can you guide me as to what are my rights? Can they get away under themember-client agreement which is so one-sided and which we have to signwithout any choice. Please write to me at Sudarshan_1106@yahoo.com.Look forward to hearing from you soon.
Rgds
Sudarshan
