| Message: I am empolyed in an MNC and plan to sell some of my nonQualified Employee
Stock Options of listed in Nasdaq.
I fall in the highest income tax slab with annual salary >10L
I have the following questions:
1) What would be the tax implications? Will i have to pay short term or
long term capitals gain tax? The transaction would be a same day cashless
transaction.
2) Recently i have heard that if we trade in shares as "investors" and not
as "traders" we have to pay only 10% tax as against 30% even for short
term capital gains tax. Will this transaction qualify for that?
3) I plan to quit my current job and utilize the proceeds of the sale for
my higher eductaion in India. Could this help in reducing the tax burden
on the proceeds?
4) Would the tax rate on the proceeds from the sale be affected if at the
time of the sale i am un-employed, i.e have already quit my job?
(The expected quantum of returns from the proceeds alone however could be
greater than 10L, so even if i am unemployed for the whole Financial year
in which i make the sale will the proceeds themselves take the tax rate to
the max slab?)
